California: A US Federal Appeals Court has raised concerns over the Trump administration’s legal attempt to invalidate thousands of mail-in ballots in California, questioning whether the federal government has the authority to interfere with the state’s election procedures ahead of the November 3 midterm elections.

During the hearing, Circuit Judge Mark Bennett expressed scepticism about the Department of Justice’s lawsuit, which seeks to exclude ballots allegedly sent to individuals identified as likely noncitizens. Bennett, who was appointed by President Donald Trump, highlighted constitutional provisions granting states primary responsibility for administering elections. He questioned whether the federal judiciary could issue an order contradicting election laws established by California lawmakers.

The three-judge appeals court panel is expected to deliver its decision as soon as possible, with Bennett indicating that the judges would move quickly given the approaching elections.

Justice department challenges California’s voting procedures

The legal dispute follows a complaint filed by the Justice Department on October 15, seeking federal intervention in California’s mail-in voting system. According to the lawsuit, federal authorities provided California election officials with a list of approximately 20,000 individuals suspected of being ineligible to vote because of their citizenship status.

The administration has requested that ballots associated with individuals identified as likely noncitizens be excluded from the election process. The case forms part of the Trump administration’s broader campaign against alleged noncitizen voting, an issue the president has repeatedly raised despite the lack of evidence supporting claims of widespread illegal voting by noncitizens.

    California rejects federal allegations

California officials have strongly opposed the lawsuit, maintaining that the state already has comprehensive safeguards to prevent ineligible individuals from participating in elections. State authorities have also questioned the reliability of the federal government’s data, arguing that the Justice Department has failed to provide sufficient evidence to justify invalidating ballots.

California Governor Gavin Newsom criticised the legal action, describing it as a politically motivated attempt to interfere with voter participation shortly before Election Day. Voting rights organisations have similarly expressed concerns about the accuracy and transparency of the federal government’s voter eligibility lists. Advocates warn that relying on potentially flawed information could result in eligible voters having their ballots rejected.

    Midterm elections heighten political tensions

The legal confrontation comes as political tensions intensify ahead of the November 3 midterm elections, which will determine control of the US Congress and several important state and local offices. Trump has repeatedly accused California of election irregularities, particularly following primary contests in which Republican candidates performed below expectations.

His administration has also pursued investigations into alleged election misconduct in the Democratic-leaning state. Critics argue that such actions could create uncertainty among voters and undermine public confidence in the electoral process.

The appeals court’s forthcoming decision could have significant implications for California’s election administration and the limits of federal intervention in state voting procedures. With Election Day approaching, the ruling is expected to attract national attention as legal disputes over voter eligibility, election integrity and constitutional authority continue to shape the political landscape.
