Israel Governing body approves law limiting conditions for current PM removal

With a final vote of 61 to 47 the Knesset approved the law, which stipulates that the Knesset or three-quarters of cabinet ministers can only proclaim a prime minister to be physically or mentally unfit and order them to resign.

Israel: Despite concerns that it would be designed to protect the current Prime Minister Mr. Benjamin Netanyahu from any negative effects of his corruption prosecutions, Israel has adopted a law restricting the circumstances under which a prime minister can be ousted.

With a final vote of 61 to 47 the Knesset approved the law, which stipulates that the Knesset or three-quarters of cabinet ministers can only proclaim a prime minister to be physically or mentally unfit and order them to resign.

The opposition claims that judicial independence is in jeopardy, while the coalition asserts that the proposals aim to restrain the Supreme Court’s overreach and restore the proper balance between the three branches of government. The coalition has proposed a number of legislative measures, including the amended definition of the prime minister’s “incapacity,” which is one of them. These proposals have thrown Israel into a state of emergency.

The stipulations fleshed out the Basic Law guidance in the event of a non-functioning prime minister, which previously lacked details on circumstances that may give rise to such situations, as per the statement. The law had meant that Netanyahu might potentially be judged unable by Attorney General Ms. Gali Baharav-Miara should she perceive an attempt by him to end the three court cases against him, according to the nonpartisan Israel Democracy Institute.
